This Privacy Policy is addressed to you, in your capacity as a USER of the internet PLATFORM https://www.travelcar.com/ (hereinafter the "PLATFORM") and is intended to inform you of how your personal information may be collected and processed by the OPERATOR and the RENTERS and/or PARKINGS of the PLATFORM. The company MHIRI INNOVATION, a simplified joint stock company with a capital of 47,270 euros, registered with the Trade and Companies Register of Paris under number 790 020 606, whose registered office is located at 45 rue de la Chaussée d'Antin, 75009 Paris (hereinafter "TravelCar.com" or "THE OPERATOR") publishes and operates the internet platform accessible at https://www.travelcar.com/. The protection of persons and data being a priority for TravelCar.com, the purpose of this Privacy Policy is to present to the USERS the content of the personal data processing implemented on the PLATFORM. TravelCar.com commits in any case to respect the following two (2) essential principles:
You remain in control of your personal data.
Your data is treated transparently, confidentially and securely.
The processing of personal data is regulated:
by the law n°78-17 of January 6, 1978 relating to data processing, files and liberties as modified by the law of June 20, 2018 (hereafter "IEL law");
by Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 (hereinafter "RGPD").
ARTICLE 1 - DEFINITIONS
CUSTOMER: represents any person having ordered a SERVICE via the PLATFORM.
USER ACCOUNT or ACCOUNT: designates the account that can be created by a USER and allowing access to the SERVICES offered by the PLATFORM. The access to the ACCOUNT is done thanks to the CUSTOMER'S IDENTIFIERS and subject to the full and entire acceptance of the present TOS.
PROCESSING CO-RESPONSIBILITY: refers to cases where several entities are responsible for the processing of personal data collected on the PLATFORM and determine, together, the means and purposes of processing.
FUNCTIONALITY: means any functionality or service offered by TravelCar.com and/or the PLATFORM.
IDENTIFIERS: refers to the elements allowing any USER to connect to the PLATFORM to access his ACCOUNT.
RENTER: means the natural or legal person offering to rent a vehicle, whether or not on a professional basis. Are considered as RENTERS the PROFESSIONAL RENTERS and the CONSUMER RENTERS:
PROFESSIONAL RENTER: means the company offering to rent vehicles to PLATFORM USERS on a professional basis. The PROFESSIONAL RENTER can be TravelCar.com.
CONSUMER RENTER: means the USER renting his own vehicle on a non-professional basis, by entrusting the rental of his vehicle to TravelCar.com as part of the "TRAVEL" SERVICE.
MEMBER: means the USER who has created an ACCOUNT on the PLATFORM.
OPERATOR: designates com, as an online platform operator.
PROFESSIONAL PARTNER: designates indiscriminately a PARKING or a PROFESSIONAL RENTER. The PROFESSIONAL PARTNERS are necessarily natural or legal persons acting in a professional capacity.
PARKING: means the natural or legal person offering to rent a PARKING SPACE on the PLATFORM.
PLATFORM: designates the internet PLATFORM accessible at the address https://www.travelcar.com/; the PLATFORM groups together all the web pages, services and functionalities which are proposed to you as a USER or CLIENT via com.
PAYMENT SERVICE PROVIDER or PSP: means the company benefiting from a banking licence mandating TravelCar.com to carry out the payment services associated with the platform in its name, on behalf of the USERS.
RESPONSIBLE FOR PROCESSING: means the entity that, alone or jointly with another, determines the means and purpose of processing personal data.
SERVICES: means, indefinitely, the different SERVICES offered by TravelCar.com as part of its status as a PLATFORM OPERATOR. Are considered as SERVICES the FUNCTIONALITIES allowing :
To rent a PARKING SPACE ("PARK" SERVICE);
To rent a vehicle to a PROFESSIONAL RENTER ("RENT" SERVICE);
To entrust TravelCar.com with the management of your vehicle rental (SRVICE " TRAVEL ").
PARK" SERVICES: refers to the FUNCTIONALITY allowing the USERS to rent a PARKING SPACE on the PLATFORM from a PARKING.
RENT" SERVICES: means the FUNCTIONALITY allowing USERS to rent a vehicle on the PLATFORM, whether it belongs to another USER represented by TravelCar.com or to a PROFESSIO RENTER.
